TERMS AND CONDITIONS

Applicable for purchases on www.drythighs.com. DryThighs is produced and sold through daByke, hereafter “daByke”, “we”, “us”.

GENERAL TERMS

This site is operated and owned by daByke IVS, CVR no.: 39145456, Porcelænshaven 26, 2. Sal, 2000 Frederiksberg, Denmark. Text, photos or videos downloaded from this site cannot be acquired for commercial use without prior concent from daByke. Please feel free to contact us at contact@dabyke.com if you wish to use our content.

Sizes are indicative, and the fit might vary depending on shape and size. Therefore, we do not guarantee that DryThighs will fit you perfectly. Please see the size guide on the product page. Using DryThighs does not guarantee dry thighs during bike rides, and is dependent on trip duration, precipitation and other weather conditions. We reserve the right to claim that information on this website, product information on label, product, hang tag or otherwise might be incorrect. DryThighs is coated with waterproof PU-coating, which eventually wears off. Therefore we recommend re-treating when necessary. 

PRICES

daByke reserves the right to claim that products may have been mispriced in our webshop. The purchase is a binding agreement when you receive an order confirmation by e-mail. We will send the order confirmation to the e-mail address you entered with your contact details prior to the payment, and we consider the order confirmation to be received by you when we send it.

All amounts stated on this site are in DKK (Danish Krone) or EUR (Euro) and is including 25% VAT. If the website language is set to Danish, prices will be in DKK. If you are on the English page, prices will be in Euro.

Prices do not include delivery. If you are ordering from outside of the European Union, you may have to pay customs duties, import taxes and VAT when receiving the items. Since the customs duties differ from country to country, we cannot estimate your total cost, as we have no control over the different customs regulations. These duties should be paid to the respective country, and it usually happens at the post office where you receive your item(s).

PAYMENT

daByke accepts payments with Dankort/VISA-Dankort, VISA, VISA Electron, Mastercard, PayPal and MobilePay. We only accept debit and credit cards issued in the European Union, Iceland, Norway or Switzerland. The payment will be effective when we send your order.

daByke uses an approved payment provider (Bambora, you can read more about their data protection here), which encrypts all your card information with a SLL (Secure Socket Layer) protocol. This means that we cannot read your card information.

DELIVERY

daByke strives to ship your order within two days of purchase. Expected delivery time is 2-7 days from shipment if the recipient’s address is in Denmark, and 3-9 if the recipient is in the European Union or EEA. daByke strives to deliver every product in a professional and timely manner. Unfortunately, obstacles relating to the delivery of your item(s) may occur outside of our control. Therefore, we cannot guarantee the delivery within the estimated delivery time. Also, we have no obligation to deliver items which are out of stock, and to deliver items which for any reason are lost during transport by a 3rd party (i.e. GLS or PostNord).

RETURN POLICY AND WARRANTY

Our warranty applies to defects in materials and/or production. The warranty does not apply for damages caused by improper use of the product. daByke will cover your return cost if reasonable. If the item(s) you have purchased from this website has defects, you should notify us within reasonable time, no later than two weeks after noticing the defect. The warranty is valid for two years from the date you receive the item(s) in accordance with Danish law.

 If you wish to make an appeal to be refunded, you can send a complaint to support@dabyke.com for an individual evaluation. The maximum refund amount is equal to the value of your purchase and requires you to return the product.

If you want to cancel your purchase, you must notify us no later than 14 days after you receive the order, and we must receive the returned products within 14 days of your notice.

The notification shall be given per email to support@dabyke.com. In the message, please let us know clearly that you wish to exercise your right of withdrawal. Remember to add your order number in the email. You can also choose to use our default cancellation form and send it together with the returned item(s). You can find the form here (PDF).

The condition of the product when you return it:
You are liable only for any deterioration of the value of the item due to handling other than what is necessary to determine the nature, characteristics and manner of the item. In other words – you can try the product in the same way as if you tried it in a physical store.

If the product is tested beyond what is described above, we consider it to be used, which means that, in the case of cancellation of the purchase, only a portion or none of the purchase amount will be returned, depending on the product’s commercial value. If you rather wish to receive a new identical item instead of a refund, we are happy to send you a new item.

DISCLAIMER, LIMITATION OF LIABILITY AND INDEMNIFICATION

daByke is not liable for any direct, incidental, consequential, indirect or punitive damages arising out of your use of DryThighs, or any other product sold through this site. By using DryThighs or any other product on the site, you expressively agree that you are using it at your own risk.

JURISDICTION

These terms and conditions are in accordance with Danish law. Danish courts will have exclusive jurisdiction in case of any dispute under this agreement. When using this website, you must comply with the laws of Denmark and any local and international laws, as they may differ from those of Denmark.
